Substitute HB59 (budget bill) Analysis

The House finance committee moved their substitute budget bill out of committee yesterday along a party line vote. Few changes were made to the education funding and policy piece, leaving the House budget bill underfunding Ohio's public schools by about $200 million less than the Governor's widely panned funding plan.

The House budget bill continues to hand gifts to the private school and for-profit charter school movement. There is a massive expansion of vouchers, only limited by household income needing ot be below 200% of the federal poverty line (currently ~$46,000). This means that for the first time, high performing districts could lose students and dollars to private schools that likely underperform their public school counterparts.

Steve Dyer has a good run down of the giveaways to charter schools, and especially the catastrophically bad eschools.

Permits an e-school that serves at least grades one through eight to divide into two schools as long as the sponsor agrees and the division is accomplished in either the 2013 – 2014 or 2014 – 2015 school year.

My hunch is this will allow one or both of two things to happen: 1) e-Schools to separate out their higher and lower performing schools and 2) e-Schools to collect more money. I'm becoming more and more impressed with William Lager -- the head of the Electronic Classroom of Tomorrow. He is fast becoming the state's new David Brennan, giving big checks to politicians accompanied by nice budget carve outs.

Once again, kudos to William Lager for getting e-School hands into another pot of public money! While Career-Tech money only constitutes about $120 million over the budget cycle, it will only add to e-School profits. I mean, what better way to learn woodworking than over a computer! I know watching those YouTube demonstrations of how to cut outside mitres have really helped my carpentry. Ask my wife!

The addition to the Houses's budget bill that caught the most attention however was a move to criminalize the teacher of sex education

The sex education amendment would ban instructors from endorsing anything other than abstinence as acceptable behavior.

The measure also would prohibit handing out contraception on school property.

A parent could sue an instructor who violates the provision and receive damages and attorney fees. And a court could issue a civil fine against the instructor of up to $5,000.

Moments before taking a vote on the amended bill, committee Chairman Ron Amstutz assured the budget was not about ideology.

When asked what motivated GOP lawmakers to propose the sex education changes, Amstutz said he didn't "have much to offer," adding that he would have to take another look at the bill's language.

"There's been a lot of questions about that," Amstutz said.

The amendment's language prohibits instruction by those who endorse "non-abstinence" or "gateway sexual activity." It defines "gateway sexual activity" by citing the Ohio Revised Code's definition of "sexual contact" listed under the section on sexual offenses. It describes such activity as any touching of an erogenous zone for the purpose of sexual satisfaction.

Innovation Ohio has a good rundown of this ridiculous piece of legislation.

The language also states that class instruction in Ohio may not provide materials that condone sexual activity among unmarried students. It even allows a parent to sue if an educator violates the restrictive provisions in the law.

In short, the state budget now mandates that Ohio adopt an abstinence-only approach to sex education program.

But abstinence education doesn’t work. Research shows this. Teen pregnancies are highest in states with abstinence-only sex education. By contrast, teens who have had comprehensive sex education are 60 percent less likely to become pregnant.

In a state budget that already defunds Planned Parenthood and directs tax dollars to Crisis Pregnancy Centers that lie to women, Ohio lawmakers are moving the state in the wrong direction for Ohio’s women and young people.

Ohio funding formula - hearings scheduled

We recently reported that it was unlikely that a new school funding formula would be rolled out this year.

If you're a school administrator, wondering what your next budget is going to look like, waiting for the release of a new school funding formula, our advice is "don't hold your breath".

Former State Rep Stephen Dyer writes today, "Ohio House Republicans announced today another series of hearings on K-12 funding and reform to be led by state Rep. Ron Amstutz, R-Wooster."

He goes on to advise

Having already led a series of hearings on this topic myself, I will give Rep. Amstutz a piece of advice: Don't start from scratch. Take advantage of these unprecedented exams of how funding and reform should work in Ohio. Just because the previous three were led by folks from another party doesn't mean they were devoid of merit. The SFAC was equal part D and R appointments. My hearings were dominated by R-backing Charter Schools. Strickland's meetings included folks from all parties.

There's a lot of money involved, and we're in an election year. Expecting this process to produce a "countrys best" funding formula is a lofty expectation that is certain to disappoint.

As we stated earlier, we suggest that they were a little trigger happy in shooting down the Evidence Based Model, and perhaps they could perform some CPR and bring it back with their own modifications.

Whatever happens, at some point legislators and the Governor must recognize they have a constitutional duty to deliver a quality, fair and equitable public education.

Outrage over school cuts rises

From emails and phone calls, to angry town halls, legislators have been on the receiving end of a backlash to the reckless budget the Governor has proposed.

Battered by angry crowds at suburban school district meetings in recent days, House Republican lawmakers will offer up changes Thursday limiting the budgetary pain inflicted on schools by Gov. John Kasich's budget proposal.

House Finance Chair Ron Amstutz said many changes to the $120 billion, all-funds budget proposed by Kasich are coming, including tweaks to a controversial blueprint for funding schools over the next two years authored by the Republican governor.

"We are looking to take the edge off of this problem across the spectrum of school districts -- not just for the upper" property wealth districts, said Amstutz, a Wooster Republican shepherding the budget through the GOP-controlled House. "But we are concerned about the districts getting high percentage cuts."

Taxpayers from those districts, many in traditional Republican territory, are also concerned -- and downright angry. Hundreds of them have been giving GOP lawmakers an earful at recent community meetings.

The "solution" being considered by the Republicans from wealthy suburban districts that are seeing large cuts is to shift those cuts to poorer school districts, as Ohio Budget Watch reports

Some Republicans from suburban districts that are receiving deep cuts in school funding are looking to change the funding model. The Plain Dealer is reporting that Representative Nan Baker’s (R-Westlake) proposal to cap cuts in funding at 20% for any one school district is being seriously considered by the House Republican Caucus. House Finance Chair Amstutz called it an “excellent amendment” that is “well conceived”. Which is kind of funny considering Governor Kasich said that no district receives a cut of over 8% in his budget but for some reason House Republicans are having to consider an amendment to cap cuts at 20%. I guess that is nether here nor there, though.

According to sources in the article, by capping the amount of cuts per school district at 20% this creates a hole of $114 million in the state budget. And how exactly to House Republicans fill the gap? Simple, by taking the small increases that low property wealth school districts receive in this budget and giving it to the high property wealth school districts.

It should come as little surprise that the theory of balancing the budget on the backs of schools and teachers was never going to be popular, however the Republican controlled legislature is still resistant to solving the budget problem in a balanced way.

But Rep. Ron Amstutz, a Republican from Wooster, and Rep. Christina Hagan, a Republican from Alliance, did make one thing clear: The House GOP isn’t going to back tax increases as a means of balancing the budget.

One thing is clear, there's very little appetite for this reckless budget. The GOP legislature and Governor now seem at odds with each other, and anger in the communities continues to rise.
