Senate budget - good, bad, ugly

The much anticipated Senate budget, when it comes to education policy, could be titled "The Good, the Bad and the Ugly". We've already discussed the ugly, let's take a look at the good and the bad.

The Good

The statewide parent trigger, proposed by the governor and eliminated by the house, is not proposed by the Senate either and appears dead, for now.

The Senate also includes a fix to HB555 and the onerous teacher evaluation provisions it contained. Here's what the fix proposes

Prescribes that the student academic growth factor must account for 35% (rather than 50% as under current law) of each evaluation under the standards-based state framework for evaluation of teachers developed by the State Board of Education and permits a school district to attribute an additional percentage to the student academic growth factor, not to exceed 15% of each evaluation.

Specifies that, when calculating student academic growth for a teacher evaluation, students who have had 30 or more excused or unexcused absences for the school year must be excluded (rather than excluding students with 60 or more unexcused absences as under current law).

Ohio Revised Code labels a student as a chronic truant if they are absent 14 days, so 30 days is still a high number of absences to allow, but it is certainly better than the ridiculous 60 days in current law. The reduction in the use of VAM to 35% from 50% is a welcome improvement.

The Governor proposed eliminating the single salary schedule, and the House concurred. The Senate however strikes this proposal from their budget. We suspect there will be pressure applied to put this back in. Educators and support professional should continue to apply their own pressure on legislators to keep it out.

The Senate also eliminated the home-school freeloading provision the House added that would have allowed home schoolers to participate in district extra-curricular activities at no expense.

The Bad

The Governor proposed a massive statewide voucher expansion effort, the House concurred, and the Senate has left the proposal in too. With massive opposition to this proposal we were a little surprised the Senate left this unnecessary proposal in their budget.

Charter schools get a number of additional free passes from the Senate, including an e-school exemption for phys ed., an additional qualifying condition for vouchers, and a provision that would make charter school closures more difficult as LSC notes it "May be more difficult to close community schools after July 1, 2013 (compared with current law after that date).". The Senate also eliminates a charter school teacher quality provision for charters populated primarily with students with disabilities. A number of other smaller provisions setting charter schools on a longer path to failure are also propsed by the Senate, such as:

Exempts students of chartered nonpublic schools accredited through the Independent School Association of the Central States from passing the end-of-course examinations as a prerequisite for graduation from high school.

The Charter school business doesn't contribute millions of dollars a year to Republican politicians for nothing.

The challenging

The Senate adds a new levy type aimed at school safety

Authorizes school districts to levy a property tax exclusively for school safety and security purposes. Requires the levy to comply with the same requirements that apply to general school district levies in excess of the 10-mill limitation.

A good intentioned proposal aimed at lowering violence in schools, but there should be concern that a safety levy might reduce local taxpayers appetites for funding levies for normal school operations, the core purpose of schools themselves. School districts will have to be mindful in how they approach this issue.

Rejected Kasich formula coming back?

The Ohio Senate revealed its version of the Budget, and it contained a number of changes to education policy proposals proposed by the Governor and the House. What it didn't contain was a school funding formula, for that we are told we will have to wait another week. A familiar story.

Based upon reporting, there should be some serious cause for concern. The Toledo Blade reports

A huge chunk still missing from the budget is how the chamber plans to deal with K-12 schools, preventing lawmakers from putting a total price tag on the two-year spending plan for the moment. Talks continue, but Mr. Faber predicted that the final product is likely to be closer to what Mr. Kasich initially proposed than what the House put forth.

Mr. Kasich’s school funding plans, particularly his promise that more money would flow to poorer schools, were initially greeted with optimism by school superintendents across the state. But that mood quickly soured when the administration released numbers showing that some 60 percent of school districts would see no funding increases while some wealthier, fast-growing, suburban districts were in line for large increases.

The House, in turned, capped the growth in subsidies to those suburban schools, resulting in more districts being in line for increases, including Toledo Public Schools. Mr. Faber would not speculate what the Senate’s total K-12 pot of funding would be larger or smaller than in the House version.

The Cincinnati Enquirer has a reaction

Senate Minority Leader Eric Kearney, D-North Avondale, said the small business tax cut wouldn’t provide business owners with enough money to create new jobs. He also lamented the budget’s lack of additional funding for local governments and schools.

“Our schools and local communities have suffered drastic cuts since Governor Kasich took office and today’s amendments by Senate Republicans to (the budget bill) did nothing to change that,” he said in a statement. “That’s not good news for local taxpayers who’ve been forced to pick up the slack from state funding cuts by voting for more local levies.”

Senate Republicans said they won’t have education funding numbers until next week, when they plan to reveal their final K-12 funding plan.

The Governor promised that poor districts would receive more, which should not have been a difficult task after he cut education funding by $1.8 billion in his last budget. But even that promise turned out to be empty as almost 400 school districts were set to receive flat funding. The House promised to fix the Governor's mess, and attempted to do so by returning to the Taft era building blocks formula - only they cut school funding by a further $200 million in the process. Now the Ohio Senate wants to return to the Governor's rejected formula. As we predicted, we have a school funding disaster on our hands, unless the Senate is also going to attach significant amounts of additional money to the plan to make it workable.

Adequately funding my school

Education helps broaden the minds of young individuals to help them achieve success in the future. All across America students go to school to learn and prepare for their futures. Just imagine the students walking into a classroom with new desks with four stable legs, new chairs that aren’t cracked or missing parts and sitting down to their personal laptop provided by the school. This sounds like a school that most parents would want their children to attend. Wouldn’t it be great if all schools had all these? Wouldn’t it be fascinating if all students were able to partake in an improved quality of education for every school?

The state's previous budget cut public school funding by $1.8 billion, which ultimately hurt Ohio's public education system. Ohio Governor John Kasich introduced a new state budget, which proposed a reform of the school funding formula. The new budget promised more money to the less funded school districts, but the promise proved empty. But the Governor, through the Republican dominated legislature, is doing the exact opposite. They are continuing to underfund public schools while increase funding to charter schools and further pushing public education into the hands of private corporations.

For the 2011-12 school year, Worthington Schools received $54,952,536 all total funds, and Olentangy Local Schools received $50,863,323. These two districts are 2 of the best in central Ohio, where they benefit from higher than typical property valuations. An essential aspect for each of these districts' high ratings is because they receive the necessary funding that a public school district should have.

However, the underfunding of public schools in Ohio is an enormous issue that affects many people, especially students. There is a need to re-work the current formula used by Ohio to determine how school funds are disbursed and also to increase public support for education funding. Limited funds for public schools have primarily affected the poor and have put them at a disadvantage in getting a quality education. Whitehall, generally speaking, has a lower property valuation. The schools in Whitehall do not receive the sufficient funding they deserve as a public school district.

Unequal funding throughout the state demonstrates the unfairness some school districts face. Is it fair that schools that reside in low property valuation areas don’t have the necessities to educate their youth?

The reason that some schools can't do things like buy computers and maintain their buildings to begin with is because the school funding system is so ineffective. The US government pays only 7% of all school money, and the rest is up to the state and the local tax-payers. Whatever money the state won't pay is paid as school income tax or property taxes, which are higher or lower depending on how much the property is worth, and the incomes of the districts residents. But this means that schools in poor neighborhoods get little money while wealthy schools get nearly all they need.

The Governor needs to start funding public education fairly and adequately. According to the Ohio Association of Independent Schools (OAIS) the vast majority Ohio students, roughly 1.85 million attend public schools, so it would make sense for the Governor to turn his attention towards public education. Despite whether a child's parents are wealthy or poor, it is in everyone's interest to guarantee that America's future generations are both highly skilled and well educated.

Republican lawmakers looking to attack working people again

On this day in 1886

350,000 workers staged a nationwide work stoppage to demand the adoption of a standard eight-hour workday. Forty thousand workers struck in Chicago, Illinois; ten thousand struck in New York; eleven thousand struck in Detroit, Michigan. As many as thirty-two thousand workers struck in Cincinnati, Ohio, although some of these workers had been out on strike for several months before May 1.

The purpose of the May Day Strike was to bring pressure on employers and state governments to create an eight-hour workday. During this period, workers commonly spent twelve or more hours of each day at work. Unions, especially the Federation of Organized Trades and Labor Unions of the United States and Canada -- the predecessor of the American Federation of Labor, encouraged workers to strike on May 1, 1886, to demonstrate the need for an eight-hour day.

Today, Ohio Republican law makers want to go back to a time that predates 1886, by introducing yet more union busting legislation. State Rep. Ron Maag (R) and State Rep. Kristina Roegner (R) are introducing so called "right to work" bills. These bills (Maag's targets public sector workers, while Roegner's target private sectors workers) come less than 2 years after Ohioans rejected SB5, the previous anti-worker legislation aimed at reducing the ability of workers to negotiate safe and fair working conditions, benefits and pay.

Here's a copy of the letter we obtained announcing the introduction of the bill, and a request for legislators to add their names to it.

The introduction of these bills come suspiciously timed - just a day after Governor Kasich met with the tea party funders, the Koch Brothers - who are big proponents of "right to work" legislation and union busting in general.

Phones and electronic devices were banned from some panels, as Koch strategists detailed next year’s electoral battlegrounds and donors committed contributions to particular states or projects.

At least a half-dozen rising Republican stars were also in attendance. They included Dr. Ben Carson, a Baltimore neurosurgeon who has quickly developed a following among grass-roots conservatives, and several members of the Tea Party wing: Govs. Nikki R. Haley of South Carolina and John R. Kasich of Ohio, along with Senators Ted Cruz of Texas and Rand Paul of Kentucky.

The Tea Party's efforts to push anti-worker legislation has been on-going in Ohio for more than 2 years. Their efforts to collect signatures to place anti-worker legislation on the ballot, by their own accounts has fallen way short

Mr. Littleton said it would be a “long shot” for the group to gather the roughly 380,000 signatures of registered voters needed by July 3, the deadline to qualify for the November ballot.

The effort is a long shot because it has no popular support. The We Are Ohio signature collection effort to repeal the last anti-worker legislation that the Tea Party supported, collected over 1.3 million signatures in just a few months. The current group of people supporting this anti-worker legislation are even more unsympathetic. For just how ugly and bigoted the Tea Party backers of "right to work" are, see here.

38 people who died on the job last year were remembered Monday at the Cincinnati region Workers Memorial, sponsored by the UAW and AFL-CIO Labor Council. Today, the Ohio GOP introduces legislation that could increase on-the-job deaths by 36%. The So-Called “Right to Work” bills could eliminate workplace safety measures fought for and obtained by labor unions. Dangerous.

“Here we go again. Apparently Governor Kasich has forgotten what happened the last time he and his Republican allies launched a broadside against the rights of Ohio workers. Ohio was paralyzed and our hard-earned economic recovery, which began a year before Kasich took office, stalled.

Just as SB 5 was soundly rejected by Ohio voters, we expect this unnecessary sideshow – which will do nothing to create more good-paying jobs – to fail, and we intend to hold Governor Kasich accountable for choosing to focus on distractions over Ohio’s middle class. If Kasich doesn’t want this attack on working families to move, he should say so immediately.”

Voucher opposition is expanding

HB59 as introduced by the Governor and passed out of the House finance committee on a party line vote, would create a statewide voucher program, based solely on household income. Eligibility would only be limited to those with incomes below 200% of the federal poverty line ($46,100 for a family of 4). Initially only covering kindergarten, it expands to first grade the following year.

This expansion would occur even in the highest performing school districts at a time when so many are still reeling from massive budget cuts the legislature is not keen to restore. Furthermore, once a student qualifies for a voucher they will forever qualify regardless of family income.

Previous attempts to expend vouchers statewide (via HB136) met with huge community resistance across at least 400 of Ohio's 60+ school districts (see the list below). Similar opposition is now growing to this provision in the budget. The following districts have all passed a resolution opposing the voucher expansion in HB59

A copy of the resolution can be found here, and reads as follows:

WHEREAS, Governor Kasich’s biennial budget (HB 59) proposes to expand the EdChoice Scholarship Program through two new options that will significantly increase the number of publicly-funded vouchers for students to attend private or parochial schools; and

WHEREAS, one of the programs provides private or parochial school tuition vouchers to any entering kindergarten student of a family with a household income less than 200 percent of the federal poverty level, to be used at the parent’s choice of participating private or parochial school; and

WHEREAS, the following year, such vouchers would be expanded to include students in both kindergarten and first grade, totaling $25 million over the biennium; and

WHEREAS, such vouchers would be granted without regard to the academic performance or quality of the public school that the student is assigned to attend; and

WHEREAS, the second voucher expansion proposed by the Governor in HB 59 expands eligibility for the EdChoice voucher program to Kindergarten through 3rd grade students enrolled in buildings that received a “D” or “F” in the new K-3 Literacy component of the New Report Card in 2 of the 3 most recent report cards; and

WHEREAS, the operation of the proposed programs would effectively reduce funds from the already financially beleaguered local public school districts, resulting in fewer resources for the education of remaining students;

NOW THEREFORE BE IT, AND IT IS HEREBY RESOLVED, that the ____________ Board of Education does hereby express its opposition to these provisions in HB 59; and

BE IT FURTHER RESOLVED that the _________ Board of Education expresses its opposition to any legislation that seeks to transfer public dollars to support private education; and

BE IT FURTHER RESOLVED that the Treasurer be directed to spread this resolution upon the minutes of the Board of Education and that copies of the resolution be forwarded to the Governor and members of the Ohio General Assembly.

We hear a lot from the Governor and his legislature about the need for students to be "college ready", which is laudable. But there's the rhetoric of "being ready" and the reality of a legislature that is making college harder, especially for students from poor families.
