So-called "right to work" Hot Potato

The House Manufacturing and Workforce Development Committee, chaired by Rep. Schuring (R) held the first reading of HB151 and HJR5 - the anti worker so-called "right to work" legislation. They heard from the bills sponsors, Rep. Roegner (R) and Rep. Maag (R).

The hearing room was packed to capacity by opponents of the bill, indeed so many people were in opposition to this bill that they filled two additional overflow rooms, and left some standing in the hallways listening over a speaker system.

As expected, Rep. Roegner and Rep. Maag gave misleading and highly selective testimony, that failed to stand up to questions from the committee. Often they had to fall back upon "feelings", "beliefs" and ad nauseam recitation of the word "freedom" like they were auditioning for the role of William Wallace in an off-Broad St. production of Braveheart.

Rep. Tom Letson (D-Warren) said Ohio law already allows employees to choose not to belong to unions and instead contribute "fair share" payments. "It seems as though the freedom you are espousing here is already in the body of the law," he said, suggesting the proposal was redundant.

The Democrat's statement drew a roar of applause from the audience, prompting Chairman Schuring to slam the gavel and warn spectators to observe proper decorum or be ejected from the room.

Rep. Roland Winburn (D-Dayton) questioned whether the measure would allow workers who choose not to pay union dues to benefit from the union's representation and called it "a right-to-freeload law more than the workplace freedom law."

Rep. Patterson said he believed allowing individual workers to "cut their own deals" with management effectively undermines the efficacy of collective bargaining and asked the sponsors if they thought the measure would weaken labor unions in the state.

The hearing was more notable for what didn't happen, rather than what did. Not a single Republican questioned their colleagues about their proposed bill, despite intense questioning by the Democrats on the committee. It was also apparent that there were few, if any supporters of the bill at the hearing.

The lack of a convincing case for the bill, a lack of support in the Republican caucus, and widespread opposition led the chairman to declare the bill dead in his committee

The chairman of a House panel that heard testimony on controversial right-to-work legislation Tuesday said there would be no further hearings on the matter in his committee.

Chairman Rep. Kirk Schuring (R-Canton) said after the hearing that members of the panel had unanimously agreed not to continue deliberations on the proposals.

"I've surveyed the committee and for a wide variety of reasons, the committee has determined that it would not be appropriate to have additional hearings on the legislation," he said in an interview.

"My individual thoughts are that I've been in the legislature now for 20 years and I have not had one union shop - an owner of a company that is a union shop or an executive from a company that is a union shop - has come to me and asked for this type of legislation," the chairman said.

"So I think it's something that does not need to be addressed at this point in time. There are a whole host of other issues regarding our economy and how we can improve the economic climate in this state that we need to address."

The chairman's comments reflect the radioactive nature of the issue currently for majority Republicans who saw an attempt to curb union collective bargaining thrown out by voters last session (SB5, 129th General Assembly).

With that, the Republicans in the Ohio House passed this hot potato to their Tea Party grassroots activists. Signature collection by right wing extremists now being the only route left for this legislation to move forward. With that signature collection deadline fast approaching, and reports that the Tea Party are struggling to collect those signatures, it is unlikely a so-called "right to work" amendment will find its way onto a ballot this year. This Leaves next year (when the governor and most of his legislative pals are up for reelection) as the next possible date, followed shortly afterwards by the lame duck session of 2014.

But for now, it doesn't look like anyone wants to be left holding this anti-worker, deceitful hot potato.

Deep Red Opposition to Kasich Funding Plan

As the 130th General assembly gets underway and begins its hearings on the Budget, questions from law makers and superintendents are already starting to heat up - and not from your typical quarters.

the most eye opening example is Superintendent of Franklin City Schools, in deep red Warren county who sent out a letter to residents calling John Kasich a liar, and asking for citizens to join him in removing him from office.

Governor John Kasich was untruthful last week, and in doing so, finally clarified that kids in poor school districts don't count.

As parents and friends of our district, I hope you will do two things: First, please join me in an active campaign to ensure that Gov. Kasich and any legislator who supports him are not re-elected. Second, I hope you will contact our state officials and urge them to ask Gov. Kasich to return to the drawing board on his school funding proposal.

Letter to Residents-Mr. Elam

Further difficult questions were posed to the Governor's education advisors during a House education committee hearing. Plunderbund captures on such exchange by Rep Smith (a Republican who won his district with over 65% of the vote in 2012)

During the hearings [video available here at 137:53] Smith asked a very moving question of Richard A. Ross, head the Governor’s Office of 21st Century Education. He simply wanted to know what, if anything, this budget would do to help the severely underfunded schools in his district, schools that are laying off teachers and other vital staff and can’t afford to provide simple classes in art of music. Ross compared his schools to the fast growing Olentangy school district in Central Ohio.

“Olentangy schools have German 1,2 and 3, Jewelry 1, Ceramics 1, Sculpture 1, Stage Craft 1, Concert Orchestra,” said Smith. ”These are things that children of Appalachia don’t get exposed to.”

“I’m not asking for synchronized swimming or a swimming pool or anything extra. I’m not asking for violin lessons or cello lessons. What I want for is my kids is music. And art… just give them a basic education,” pleaded Smith.

State Rep Smith also tells the story of Symmes Valley School District where the Superintendent had to layoff his board secretary, transportation director and curriculum director and is now doing all of those jobs himself. Another school district in Smith’s area has lost 40 teachers and the rest have had no raises in four years.

Smith ends by asking Ross asking if there is any “special sauce” in this budget that will help superintendents just provided a basic education to the kids in his district?

the Governor's advisors told Rep Smith that perhaps students in his poor district could learn music online. Then they laughed. They may not be laughing much longer, as opposition to the second worst school funding plan (The worst being their previous plan that cut almost $2 billion from school budgets) is increasing and hardening even in red corners of the state.

Stephen Dyer notes that Governor Kasich ought to be worried. We agree.

Partisan purges

Fresh of their electoral defeats that produced a large majority thanks to partisan gerrymandering, the extremists in the Ohio House are not done with their partisan purging. Now they are going after the Ohio Accountability Task Force, according to a report in Gongwer

The task force, which first met in December 2003, was tasked with examining how to implement the value-added report card measure in ways that are most useful for improving student achievement, according to ODE documents.

With its name changed to the Ohio Accountability Advisory Committee, the panel's membership would see "substantial" changes including the removal of: the ranking minority members of the House and Senate education committees, a teachers union representative, a school district board of education member, and a school superintendent, Mr. Stebelton said.

It instead includes three members of the public each appointed by the Speaker of the House and the Senate President, two appointed by the governor and one appointed by the state auditor, he said. The superintendent of public instruction would be a nonvoting member.

"It sounds like from this list that what's been removed from this group, from this board is representation of folks who have experience in education," Rep. Nickie Antonio (R-Lakewood) said.

When Republicans are questioning the merits of the partisan purge you know there must be something wrong. Rep Stabelton, who is sponsoring the legislation (HB555) revealed his partisan purpose when he had this to say

"This will work both ways. Someday when you get back in the majority, our people won't be on it and you folks will."

Of course, due to extreme gerrymandering, Rep Stabelton knows full well that Democrats can never be back in the majority no matter how many Ohioans vote for them. The other real problem with this ridiculous proposal was also repeatedly noted

She (Rep. Denise Driehaus) also raised issues with the lack of presence of local education officials on the panel. "As the committee stands now there are some guarantees that some local representative and folks with education backgrounds, people that are participating in our system now" will be on the committee.

The Ohio General Assembly needs more not less expertise advising it, they have been making an awful mess of education policy these last few years listening to partisans with no education expertise like Rep Stabelton.

Teachers to the legislative rescue

We brought HB555 to your attention quite some time ago. Yet another vehicle for school "reform". It was mothballed, but now appears to be getting a dust-off according to Gongwer, and readied for lame duck action

The House Education Committee is scheduled to meet on three days in the week following the election, and the chairman said Thursday the yet-to-be-completed report card rating bill will be top priority during lame duck.

With meetings set for the afternoons of Nov. 13-15, Chairman Rep. Gerald Stebelton (R-Lancaster) said it is possible the committee will hear other bills, but the main focus will be on legislation to revamp the state's grade cards for school districts and buildings.

Rep. Stebelton introduced a placeholder bill during the summer (HB 555) that currently contains language stating the General Assembly's intent to put in place a system by Dec. 31. He said Thursday, however, the bill is not "totally completed yet."

"The subject matter of 555 is the highest priority (for lame duck)," he said in an interview. "We've had a lot of negotiations and there's still a lot of moving parts."

Mr. Stebelton said he is hopeful the legislature can reach consensus with the governor's office in time to have the bill passed by the end of the year as intended. He has been working with administration officials, the Department of Education and the Senate, he said.

Rep Stableton would be wise to wait just a short while, he might have some actual educators join him in the state legislature, who can help guide him to better policy, instead of creating a mess like this one

Reading Guarantee: Mr. Sawyers said the department is asking for a change during lame duck session to the third-grade guarantee, specifically to a requirement that students with a reading deficiency be assigned to a teacher with a "reading endorsement."

Because teachers with such a certification are few and far between, the agency wants clarification that would align the requirement of a high-performing teacher with the reading endorsement for the time being because acquiring the training for the title requires 12 to 16 semester hours of college credit, he said.

"It's not practical that between January of 2013 - if they're not already in a fall semester someplace - between January and then when they will start again in August that we're going to have this mad rush of people going out to get this reading endorsement (and) that can actually complete 12 to 18 semester hours of credit," Mr. Sawyers said.

"There's got to be an alternative, ultimately, that's put in place for fall (2013), so we're proposing to the General Assembly, what could that alternative be?"

Oh dear. We wrote about the mixed messages and policy mess the legislature has caused with this, so it's good to see ODE acknowledge the problems too. But, these are the kinds of problems that simply would not occur if legislatures with no education experience or background listened to those who have, and hopefully come January, that will include a number of colleagues.

555. That's the new number that Ohioans interested in education policy will need to watch next. H.B.555 is starting life out as a placeholder for the school ratings policy that was stripped from SB316 due to strenous oposition. According to Rep Stebelton, the bill will have substance around imd September, after aseries of meetings with law makers, DOE, school admins and superintendents and OSBA.

H.B.555 is also likely to be piled high with other edcuation policy changes. Report cards for drop out schools, charter schools and peformance standards for eSchools are likely to be included. Gongwer is also reporting that ODE has drafted recommendations it intends to present to the General Assembly, and Rep. Stebelton said H.B.555 could be their destination.

It should be noted that the districts listed below are new as a consequence of the legislative redistricting process that happened last year.

Tom is a member of OFT and has been President of Cleveland Heights Teachers Union for 20 years. Tom started his teaching career at Wiley Junior High School in 1972. He taught social studies there until 2005, when he became a social studies teacher at Cleveland Heights High School. He will be facing an incumbent Rep of former district 42, Kristina Roegner in November. Rep. Roegner voted against the middle class when she cast he vote for SB5 and HB153.

House district 45 - Teresa Fedor (D)
House district 45 - Teresa Fedor
Rep. Teresa Fedor currently represents district 47. A member of OFT, she attended the University of Toledo, received a Bachelor of Science in Education and spent 18 years as a classroom teacher. She has no opponent in the primary of the general election. You can read more about Rep. Fedor, here.

House district 47 - Jeff Bunck (D)
House district 47 - Jeff Bunck
Jeff is a member of OEA. Jeff is a retired high school government teacher and said the Republican attempt to thwart collective bargaining sparked his decision to run for a seat in the Ohio House against a GOP incumbent in suburban Toledo. The debate will still be fresh in the minds of voters next year, he said.

"It will level the playing field a whole lot even in gerrymandered districts like the one I'm running in," said Bunck, who's 59 and never run for office before.

With no opponent in the primary will be facing incumbent Rep. Barbara Sears who was a vote in favor of SB5 and HB153.

Matt Lark is now running unopposed in the primary and will face incumbent Rep. Terry Boose who voted for SB5 and HB153, and against the middle class. Matt is a member of OEA, and has spent the last twenty years working as a high school science teacher in Ohio. The first six years of his career were with the Toledo Public School system while the last fourteen years he has worked at Norwalk High School. House district 58 - Bobby Hagan
Rep. Hagan was first elected to District 60 in 2006, but is running for re-election in District 58 in 2012. He is a member of the Brotherhood of Locomotive Engineers and Trainmen. He is unopposed in the primary and general election, as incumbent Terry Boose has decided to run for reelection in district 57.
